Why is romeo banished from verona instead of being put to death?

Tybalt killed Mercutio. And Romeo was angry and fought Tybalt. I think he was only banished because his purpose of fighting with Tybalt was just to seek revenge and because the weapon that killed Tybalt was not actually stabbed on him by purpose but by accident only.
